At the end of December of the 29th year of Chengshun, after a month-long discussion and extensive listening to many opinions from people from all walks of life, including workers' groups, private enterprises, heads of government-run enterprises, and local officials, the decision was made.
The Dachu Empire officially promulgated a brand new law called the 'Labor Security Law', which covers all aspects of labor contracts, minimum wages, maximum working hours, statutory holidays, overtime pay, work-related injuries, etc.
All companies that hire employees must sign a labor contract with the employees. The labor contract must adopt the official standard template, and the terms must not be changed without authorization. The contract period must be at least one year.
According to the labor contract, the company is not allowed to fire employees without reason during the contract period. Forcible dismissal requires supplementary salary compensation equal to the number of years of service plus two.
Unless the employee violates the employee code within the scope of the Labor and Social Security Law, such as not following work arrangements, arriving late and leaving early, being a miner, leaking corporate secrets, etc.
In addition, companies are not allowed to fire employees or impose fines or claim compensation on employees based on their own employee rules, oral agreements, separate contracts, third-party contracts, etc.
To dismiss employees and impose fines, the workers' code of conduct stipulated in the Labor and Social Security Law must prevail, and any regulations set by the enterprise are invalid.
Including losses to the enterprise or indirect losses caused by errors during working hours, losses to third parties, etc., the enterprise has no right to require labor compensation. All losses should be regarded as normal employment risks, and the losses shall be borne by the enterprise itself.
Of course, intentional damage to corporate property is an exception. If the amount of loss exceeds a certain value, it is still a crime of intentional damage to property, which is a criminal offense. Not only must you pay compensation, but you may also go to jail.
In addition, even if there is no labor contract, as long as long-term and continuous actual employment occurs, it is deemed to be actual employment, and workers also enjoy all legal rights and interests.
Third-party dispatched workers or self-employed short-term employees shall not exceed 10% of the total number of employees of the enterprise.
In addition, third-party labor dispatch employees must also sign legal labor contracts. Labor service companies and dispatch workers also need to sign formal legal labor contracts and enjoy all labor protections in accordance with the law. The number of short-term temporary workers shall not exceed 10% of the total number of employees.
Minimum wage standard. The minimum hourly wage standard is set by the empire as a unified minimum standard across the country. Each province and prefecture can base its average salary level on the superior standard based on its own economic conditions, and can only float upwards, but must not reduce.
Each province and government publishes minimum wage standards every three years. All enterprises in their jurisdiction must sign labor contracts with workers and pay wages strictly in accordance with the minimum wage standards. Violators will be severely fined.
For example, the national unified minimum wage standard in the Da Chu Empire is 2.4 Chu Yuan, the minimum wage standard in Jiangnan Province is 3.2 Chu Yuan, and the minimum wage standard in Songjiang Prefecture is 3.8 Chu Yuan.
The minimum salary standard for subordinates can only be increased on the basis of the minimum salary standard for superiors and cannot be reduced.
For example, in places with relatively backward economies, such as an inland prefecture, the minimum monthly salary standard is only 2.4 Chu yuan. This is also the national minimum standard uniformly formulated by the Chu Empire. The province also adopted the minimum standard of 2.4 Chu yuan. When it comes to this mansion specifically, we can only use the standard of two point four Chu Yuan and cannot lower it any further.
The monthly salary is 2.4 Chu Yuan, which is the minimum salary standard in the Chu Empire.
At the same time, this minimum standard applies to workers in all institutions. No matter what enterprise or institution employs them, no matter what position they are in, whether they are male or female, old or young, long-term or short-term, their salary and benefits must not be lower than this figure. .
Short-term employment is based on this standard and converted into hourly wages.
The maximum working hours are: regular working time shall not exceed ten hours per day, and overtime work shall not exceed two hours as overtime work. That is to say, regular working time and overtime working time together shall not exceed twelve hours per day.
To ensure employees' rest breaks and physical health.
Regular working hours for heavy, high-temperature, dangerous and other positions shall not exceed eight hours, overtime hours shall not exceed two hours, and the maximum working hours per day shall not exceed ten hours. Enterprises are also required to provide cooling drinks, safety measures and other necessary working conditions.
Injuries occurring during working hours or outside working hours but caused by work assigned by the enterprise are regarded as work-related injuries, and the company shall bear the treatment expenses, nutrition expenses, etc. If the employee dies due to work-related injuries, pensions and funeral expenses are also required.
At the same time, it is stipulated that the statutory rest day shall be extended to one day every ten days, but it is required to provide no less than half a month of paid annual leave every year. Employees can apply for paid annual leave after one year of employment based on their own needs. If it is less than one year, it will be converted on a pro-rata basis. .
It is worth noting that the Dachu Empire does not have the concept of a week of seven days. That is a Western religious concept and does not exist in the society of the Dachu Empire. The working days of the Dachu Empire are based on the traditional 30 days of each month.
If you work overtime outside regular working hours every day, you will be paid 1.5 times the salary. If you have to work overtime on statutory holidays, you will be paid double the salary.
In addition, there are a series of other messy clauses, which are basically formulated from the perspective of protecting the interests of employees.
In order to ensure the implementation and promotion of the labor and social security law, the Dachu Empire established the General Administration of Labor and Social Security, with a level ranging from second grade to directly under the cabinet.
This department specializes in protecting the interests of workers, accepting workers’ representations and arbitration, and has the right to impose administrative fines on companies that violate labor and social security laws. The department also provides individual bonuses for reporting companies that violate labor and social security laws. Deducted directly from the fine.
The implementation of the Labor Security Law was also the first time that the Chu Empire protected the interests of workers at the legal level.
Of course, there will definitely be a lot of problems in the subsequent implementation, but you can't just ignore the problem for a long time. If you find the problem after doing it, you can gradually improve it.
In short, Luo Zhixue wants to firmly hold the workers group in his hands, and will never let this huge group, which will continue to grow in the future, wander outside the foundation of the empire.
And the price is right!
Naturally, the interests of various enterprises, especially those private enterprise capitalists, have been lost.
As for government-run enterprises... They are government-run enterprises, and the money belongs to the state. The people in charge of government-run enterprises will not feel sad.
The money of private enterprises belongs to the capitalists themselves. If you ask them to give workers more wages and more rest time, it will increase their cost expenditures and reduce the competitiveness of enterprises. The key is to take it from their own pockets. Take out money.
Therefore, the opposition business is quite large.
But this objection is useless.
Because the economic main body of the Da Chu Empire is still official capital, the economic proportion of private capital in the Da Chu Empire is actually not large, only about 30 to 40 percent.
Most of the famous enterprises in the Da Chu Empire are actually government-owned enterprises. There are actually very few large private enterprises, and even for large private enterprises, many of their shareholders are also official capital.
For example, Lee Iron Steel!
This enterprise can be said to be the flagship among private enterprises, but in fact, more than 50% of the company's shares are in the hands of official capital.
For example, the three-level government agencies of Guangdong Industry Department, Guangzhou Industrial Office, and Foshan Industrial Division hold about ten percent of Lee Steel's shares, and there is also a government-run financial institution that holds about ten percent. shares, and some government-owned enterprises, such as Guangzhou Iron and Steel Company, also hold a certain proportion of shares in the company.
In the end, official industrial institutions and government-run enterprises jointly held more than 50% of Lee Steel's shares, but they were scattered among dozens of institutions or enterprises. It was not obvious to outsiders. On weekdays, government-owned capital does not interfere much with the company's operations, and the Foshan Li family continues to control the company.
But when necessary, officials can take control of the company and decide on major strategies.
There are actually many similar situations.
When doing business in the Dachu Empire, it's nothing if the scale is average.
But if you want to continue to make the company bigger and stronger, and have a great influence, well, for example, if you want to achieve the level of Li's Iron, Su Qin Textile, and Song's Glass Company, there will be no official capital. support is difficult to achieve.
It's not administrative interference or anything like that. The Chu Empire has long stopped intervening in business.
It's purely market behavior!
Because official capital is also capital, and official capital also pursues profits... When capital sees you making money, it will naturally want to get a share of the pie.
It doesn't matter if you don't want to accept investment or cooperation from official capital. Official capital won't force you, and they don't even care, but they will turn around and invest in your competitors...
In the Dachu Empire, the largest capitalists were actually the Ministry of Industry and the Ministry of Finance, followed by the Royal Asset Management Department, the Industrial Departments of various provinces, and then the Industrial Departments of each prefecture and the Industrial Departments of each county.
These are the big capitalists. Not only do they hold huge sums of money, but they also control a large number of companies and control the lifeblood of all walks of life.
The so-called capitalists among the people are nothing compared to these official capitals.
A series of labor and security laws were first implemented in government-run enterprises, and of course official administrative agencies were also indispensable.
As for private enterprises, they will be temporarily given a buffer time to wait until June 1, the 30th year of Chengshun, before implementation.
After being implemented at the same time, the company will still be given half a year to adapt.
If it is really strictly implemented, it will start from January 1, the 31st year of Chengshun.
To put it bluntly, government-run enterprises will make prototypes first, and private enterprises will gradually follow up based on the situation. After one year, full implementation will be implemented.
However, even if one side is implemented throughout the year, Luo Zhixue estimates that the coverage will be relatively limited. Those large enterprises will naturally abide by laws and regulations, but some small and medium-sized enterprises, especially some micro enterprises, small workshops, small shops and other businesses Institutions, it is estimated that it will be difficult to fully implement.
On the one hand, the person in charge of the company does not want to bear more labor costs; on the other hand, it is also because the workers themselves lack legal knowledge; thirdly, even if the workers know that there is such a labor security law, they will still tolerate it because of the high cost of rights protection and other factors. .
Therefore, although the enacted labor security law is relatively complete, it is still very difficult to fully promote it. Don’t expect it in the short term, and even in ten or twenty years, it will be difficult for every worker to obtain comprehensive labor security. very difficult.
Luo Zhixue is very clear about this.
But even so, we still have to do it. Things should be done step by step and solved one by one.
Therefore, Luo Zhixue's goal for the implementation of the labor and social security law is not big. He only needs government-owned enterprises and private medium and large enterprises to follow the policy, while small and micro enterprises should take their time.
When a series of labor and security laws were announced one after another, the world was shocked. Countless workers were naturally very happy, while many private enterprises were sad.
Many so-called economists are also worried about the increase in corporate labor costs after the promulgation of the Labor and Security Law, which will lead to lower corporate profits and insufficient development, and then worry about the development of the entire economy.
But when the new year turned and the labor and social security law began to be implemented in many government-owned enterprises, Chengshun's economic data for the first quarter of 2019 did not decrease, but actually increased.
In particular, the growth rate of consumption data is very obvious!
After residents' consumption increased, it also drove the growth of various industries.
Such a strange situation has silenced many so-called economists who had previously denounced economic development.
After a series of investigations, Luo Zhixue finally saw the reason why Chengshun's economic data in the first quarter of 30 years increased abnormally.
Because of the widespread implementation of labor security laws in government-run enterprises, workers have more money and more money to spend.
At the same time, because of the existence of labor contracts, there is no longer much worry about the future, and consumers are more daring to consume.
The combination of the two has significantly increased the consumption power of workers in government-run enterprises, and has even led to an increase in the consumption of real estate and large household products.
This link leads to increased demand in various industries and ultimately drives overall economic growth.
The reason is very simple. Only when workers have more money and their future is guaranteed can they dare to consume and consume. Only when consumers produce products can they sell more products.
After reading the report, Luo Zhixue said to a group of ministers: "Those entrepreneurs who oppose the labor security law don't even think about it. Workers have no money and no guarantee for the future. Who can they sell the products they produce?"
The economy needs to be cyclical. All the money has been taken away by the capitalists. How much money can the capitalists spend even if they spend lavishly? How much product is consumed?
Judging from the macroeconomic data, the implementation of this labor security law not only protected the interests of the workers' group, but also brought the workers' group into the foundation of the empire's rule, which was politically beneficial.
Even economically, it has greatly stimulated economic growth. Although the labor costs of enterprises have increased, market demand has also increased, and they can make more profits by adopting small profits but quick turnover.
This wave is a win-win situation for the government, most enterprises, and workers.
Well, exceptions are a few capitalists who are stubborn and refuse to let go of their money, or companies whose corporate competitiveness is not very good.
They are inevitable victims of the development of the times.
And their fall also made the empire more prosperous!
